Referral Network Agreement

Version 1.0. Effective [DATE]. For clinics, firms, case managers and community organizations.

1. What this is

The Hurt Square Referral Network lets regulated professionals and community organizations make our recovery documentation guides available to the people in their care, without any payment or financial benefit flowing to the professional.

We built it this way on purpose. Physiotherapists, chiropractors, kinesiologists, psychotherapists, lawyers, paralegals and insurance professionals are bound by conflict of interest standards that restrict or prohibit accepting commission on products recommended to patients or clients. Rather than ask you to navigate that, we removed the money. The benefit goes to the injured person instead of to you.

2. No financial benefit

This clause is the heart of this agreement, and it is written plainly so that any regulator, employer or patient reading it understands it immediately.

Members of the Hurt Square Referral Network receive no commission, referral fee, rebate, kickback, revenue share, bonus, gift, equipment, hospitality, sponsorship or any other financial or material benefit from Hurt Square, in any amount, at any time, in connection with any purchase made by any patient, client or member of the public.

No payment is offered. No payment will be made. There is nothing to disclose to a patient as a financial interest, because there is none.

3. What a member receives

  • Patient discount code. A code giving 15 percent off any Hurt Square guide. The discount belongs entirely to the person buying it.
  • Reference copy. One complimentary copy of the guide relevant to your province and practice area, for your own reference.
  • Intake insert. A printed one page insert suitable for intake folders and discharge packages.
  • Directory listing. Optional listing on the Hurt Square directory of participating organisations.

The reference copy is for your professional use. It is not for redistribution, photocopying or forwarding.

4. What a member agrees to

4.1 Optional, never pressured. You present Hurt Square guides as one option among others. You will not require, pressure, or condition any aspect of care or service on a person's decision to purchase. You will make clear that declining changes nothing about the care or service they receive.

4.2 No advice claims. You will not state or imply that Hurt Square guides are legal, medical or insurance advice, replace professional care, or will secure, increase or accelerate any settlement, benefit or claim outcome. They are documentation tools.

4.3 Alternatives remain available. You will make clear that the guides are available directly from hurtsquare.ca, and that a person may purchase from us without using your code, or not at all.

4.4 No patient information. You will not provide Hurt Square with any patient, client or member name, contact information, health information or claim information, and you will not add anyone to a Hurt Square mailing list on their behalf. We do not want it, we will not accept it, and we do not need it for the code to work. Any personal information a purchaser gives us, they give us themselves.

4.5 Accurate use of materials. You will use our materials as supplied, without alteration, and will remove them at our request.

5. Your regulatory obligations remain yours

You are responsible for compliance with the standards of your regulatory college, law society, employer or governing body. Nothing in this agreement is professional or legal advice, and joining the Network does not transfer that responsibility to us.

If your college or firm requires disclosure of any relationship with a supplier, please disclose this one. There is nothing here you would not want a patient to know.

If your governing body asks you to end this arrangement, please do so, and tell us so that we can close the listing.

6. Brand use

We grant you a limited, revocable and non-transferable licence to display the Hurt Square name and logo on your premises, website and patient materials, solely to indicate participation in this Network.

Please do not alter the logo. Do not suggest that Hurt Square endorses your practice, your treatment or your results. Do not describe yourself as an affiliate, agent, partner or representative of Hurt Square. All rights remain ours.

7. Directory listing

Listing is optional and requires your written consent. It shows your organization name, city, province and practice type. It does not imply endorsement in either direction. You may ask us to remove it at any time and we will do so within seven days.

8. Term and withdrawal

This agreement continues until either party ends it.

Either party may withdraw at any time, for any reason or none, by written notice. There is no term, no exclusivity, no minimum, no quota, and no obligation to refer anyone.

On withdrawal your code is retired, your listing is removed, and you stop using our materials within seven days. Any code already given to a person remains honoured for 30 days, so that nobody is caught out part way through a purchase.

9. Liability

Hurt Square guides are documentation tools and do not constitute legal, medical or insurance advice. We make no representation about outcomes.

Neither party is liable to the other for indirect or consequential loss arising from this agreement. Nothing in this agreement limits liability that cannot be limited by law.

10. Governing law

This agreement is governed by the laws of the Province of Ontario and the federal laws of Canada applicable in it.
